NIGERIA 2015: My thoughts as we approach March 28, April 11 Polls ! By FEMI SHODUNKE
Nigeria is my dear country. And another country, which some
of you know, indeed, I can proudly claim, is "my country,” too. And I have
come to stay in both countries.
However, there is a country. And there is a country too.
But, there are sharp differences between these two countries, by wide margins,
despite certain obvious similarities.
The funniest thing is the inhabitants are the same: good
education, fantastic vocabularies, great human and material resources to their
optimal advantages. Many similarities. Though, there are few instances of
lagging behind by the other country in Africa. And it's quite unfortunate and
sad.
But during elections, citizens of a country see themselves
as one, and the citizens of the other country see themselves as arch and stout
enemies - with humongous venom.
To come home, let me draw this example. Elections were held
in Canada - at the federal, provincial and city levels not too long ago.
As the
elections approach, there was no bickering between, and among, candidates. No
thuggery. No tearing of posters. No inducement with dollars. No wooing of
voters with PDP's bags of rice, loaves of bread or 'sobo' milks. No inscription
of APC's on recharged cards, indomie noodles or exercise books. No use of
religion, ethnicity, tribe, geopolitical zones, militia groups to campaign. No
hate speeches.
Nigerians in Canada back Jonathan’s re-election bid, urge electorates to vote him en-mass

the re-election bid of President Goodluck Jonathan.
The Nigerians in Diaspora appealed to Nigerians at home to

enough to earn a second term.
No fewer than 50 Nigerian professionals who are medical
doctors, engineers, economists, educators, captains of industries, legal luminaries,
and policy analysts met in Toronto, Ontario and endorsed Jonathan for another
four years.
They promised to support the president, after his victory in
Saturday’s elections, in the creation of two million jobs in the mortgage
sector in Nigeria.
Why I owed Osun workers 5 months salary- Aregbesola
Governor Rauf Aregbesola of Osun has opened up on his inability to pay the salaries of workers in the state for five months, blaming it on “declining federal allocation.”
The governor made the open confession yesterday at the 7th Bola Tinubu Colloquium organised to mark Tinubu’s 63rd birthday in Lagos.
He said he was deeply pained and unhappy that he had not been able to pay workers salaries.
“I have found it hard to pay the wage bills owing to the declining federal allocation to the state.
“Federal allocation to the state has reduced by 40 per cent since 2013, making it difficult for government to meet up its responsibilities,” he said.

NCC appeals against court's order to pay N500million damages to APC
NCC EVC, Eugene Juwah |
Dissatisfied by the ruling of Justice Ibrahim Buba of the Federal High Court, Lagos that the Nigerian Commissions Commission (NCC) should pay the sum of N500million as damages to All Progressive Congress (APC), counsel to the NCC, Mr. Paul Usoro (SAN), has gone to the court of Appeal to appeal against the judgment.
Citing eight grounds for the appeal, the counsel said he has the mandate of his client, the NCC to appeal against the entire judgment.
The Senior Advocate of Nigeria (SAN) averred that the trial judge erred in law when he dismissed the Appellant’s Notice of Preliminary Objection of March 2, 2015, which challenged the competence of the suit on the grounds that same was unmeritorious;
He also said on ground two that the learned Trial Judge erred in law when he held that the suit of the APC disclosed cause of action against the applicant.
Usoro, in the notice of appeal, noted that the trial court misdirected itself in law and fact when it held that the suit as constituted fell under the context of chapter IV of the constitution of the federal republic of Nigeria 1999 as amended and not rooted in contract.
He explained in the notice of appeal that the trial court erred in law and occasioned grave miscarriage of justice when it held that the first respondent has seemingly complained of discrimination by the appellant.
The notice of appeal also said the learned trial judge erred in law when he held that the appellant has indeed discriminated against the 1st respondent when it granted the Goodluck/Sambo Presidential Campaign Organization in 2011, the right to use short codes and did not allow the first respondent same right in 2015.
Part of the notice of appeal is that the trial judge erred in law when it invalidated the appellants’ directive contained in its letter of January 19, 2015.
Usoro said in the NCC appeal that the learned trial judge misdirected itself in law and on facts when it awarded N500 million as damages and compensation for 1st respondent.
That the judgment is against the weight of evidence and submissions before the trial court is a very good ground for its appeal.
The appeal filed on Tuesday march 24, 2015 at the court of appeal, Lagos seeks an order of the court of appeal allowing the appeal and setting aside in its entirety the judgment of the trial judge made on march 24, 2015 including the monetary damages of N500million awarded in favour of 1st respondent.
PRESIDENTIAL ELECTION: Buhari escapes disqualification as court adjourns suits to April 22
Justice Adeniyi Ademola of the Federal High Court, Abuja has adjourned further proceedings in all suits relating to the challenge of the Presidential candidate of the All Progressives Congress (APC), General Mohammadu Buhari’s alleged certificate irregularities to April 22 and 23.
There are four of such cases before the judge.
He said it was impossible for the court to conclude the case before the elections and that there was no need for the court to be in haste to determine the case, because it could always do so after the elections.
He further said his decision to adjourn to April was because of the approaching Easter Vacation of the court.
Justice Ademola said this shortly after delivering a ruling in the suit by Chukwuweike Okafor and another against Buhari and two others (one of the four cases).
The judge, in the ruling, dismissed the applications by a Lagos-based lawyer, Ebun-olu Adegboruwa and Chukwuma Ochu to be made parties in the case. The judge said they are not necessary parties in the case.
While rounding off the ruling, Justice Ademola suo motu (without any prompting by parties) adjourned further proceedings to April 22 and 23.

Court orders NCC, MTN, Airtel to pay N500m for blocking APC’s fundraiser
A federal high court in Lagos has mandated the Nigerian
Communication Commission (NCC) to pay N500 million to the All Progressives
Congress for suspending the party’s presidential campaign fundraising platform.
In a judgment on a fundamental human rights enforcement suit
filed by APC, Justice Ibrahim Buba held that the NCC acted beyond its powers in
suspending the fundraising platform of the APC, which was meant to generate
funds to prosecute the presidential bid of the party.
NCC had ordered telecoms firms Etisalat, MTN, Glo, Airtel
and Visafone to stop running the SMS Code platform 35350 created by APC to
raise funds. Issuing the directive, NCC had warned the telecoms firms against
running political promotions that would portray them as being partisan.
